aepell’s promotions and giveaways (the “Giveaways”) are organized by aepell GmbH (“aepell” or “we”). These Giveaway general terms and conditions (“Giveaway T&C”) apply to any and all Giveaways organized by aepell.

ELIGIBILITY

You must be over the age of 18 to enter an aepell Giveaway. Employees of aepell are not eligible to participate.

DATE OF GIVEAWAYS

The Giveaways shall start and close on the dates specified on the aepell website and/or aepell newsletter and/or Instagram (@aepellskin). Entries after the closing date will not be allowed.

HOW TO ENTER

The Giveaway announcements on the aforementioned channels explain the entry procedure. There is no entry fee and no purchase necessary to enter the Giveaways. Unless otherwise specified in the relevant announcement, only one entry will be accepted per person. Multiple entries from the same person will be disqualified.

THE WINNERS

The winners will be chosen at random from all correct entries. The winners will be notified via aepell’s official account (@aepellskin) by direct message on Instagram and/or via email within five business days after the closing date of the Giveaway. If any of the winners cannot be contacted or do not claim the prize by completing the skin quiz and ordering the relevant products within 48 hours, we reserves the right to withdraw the prize from such winner and pick a replacement winner. Our decision in respect of all matters to do with the Giveaway will be final and shall not be subject to review or appeal by any entrant or by any third party.

PRIZE

The promotional prize shall be the aepell product(s) as indicated on the Giveaway announcement. The prize is as stated and no cash or other alternatives will be offered. The prizes are not transferable. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice.

PERSONAL DATA

Each winner agrees that, by participating in a Giveaway, aepell may disclose the winner’s name and social media account name without additional approval being required, including posting in a winner’s list, Instagram post, Instagram stories or the newsletter.

COMPLAINTS

Any complaints in respect of the Giveaway shall be submitted in writing to aepell at hello@aepell.com within 2 weeks after the closing date of the Giveaway. We will handle complaints as soon as reasonably possible.

LIMITATION OF LIABILITY

By entering the Giveaway each entrant agrees to release, discharge and hold harmless aepell, its legal representatives, respective officers, directors, employees and agents from any damages whatsoever suffered or sustained in connection with the Giveaway or the acceptance of the prize.

CANCELLATION & AMENDMENTS

We reserve our right to cancel the Giveaways at any times or change the provisions of the Giveaway T&C at our sole discretion and such change shall have immediately effect upon the publication thereof.

MISCELLANEOUS

The applicable provisions regarding the processing of personal data can be found in our Privacy Policy, which is hereby incorporated by reference.

These Giveaway T&C and all legal disputes arising from them shall be governed by the laws of the Republic of Austria, excluding the UN Convention on Contracts for the International Sale of Goods. In dealings with end consumers within the EU, the law of the end consumer’s place of residence shall be applicable, insofar as it is mandatory under applicable law.

Vienna (Austria) shall be the exclusive venue for all disputes arising from or in connection with contractual relationships between the entrant and aepell.

Customers have the possibility to submit complaints to the online dispute resolution platform of the EU: http://ec.europa.eu/odr.

You can, of course, also send any complaints directly to hello@aepell.com. We are not required, nor willing to participate in a dispute resolution procedure before the consumer arbitration board.

If one or more provisions of these terms and conditions are invalid, the remaining provisions shall remain unaffected. The invalid provisions shall be replaced by the statutory provisions.
